Section 18-167 Registration statement required for peddlers
Prior to the adoption of 18-167 on 12/08/2003, Section 18-167 read as follows.
Any person desiring to engage in solicitation of funds within the corporate limits within the city for an institution, organization or cause having a charitable purpose shall provide, on a form to be supplied by the city clerk, the following information:
(1) The name of the person registering and desiring to solicit funds for charitable purposes;
(2) Whether the person registering is a natural person, partnership, corporation or association; and:
a. If a natural person, the person's business or residence address and telephone number;
b. If a partnership, the names of all partners and the principal business address and telephone number of each partner;
c. If a corporation, information shall be given as to whether the corporation is organized under the laws of the state or is a foreign corporation and the mailing address, telephone number and business location of any local or regional office making the application and mailing address of home office of the corporation and telephone number of the home office shall be given;
d. If an association, the registration statement shall show the names and principal business or residence addresses and telephone numbers of the officers and directors or trustees; if the association is part of a multistate organization or association, the mailing address and business location of its home office shall be given, in addition to the mailing address and business location of any local office the association may operate;
(3) A brief description of the objectives of the solicitation effort and if applicable, a brief description of the charitable purpose for which the funds are to be solicited and a brief explanation of the intended use of the funds toward that purpose;
(4) The name of the individual in charge of the disbursement of any proceeds of the solicitation;
(5) The name, mailing address and telephone number of the person who will be in direct charge or control of the solicitation of funds;
(6) The time period within which the effort of soliciting of funds is to be made, giving the date of beginning of the effort and the projected date of conclusion;
(7) A description of the methods and means by which the solicitation of funds is to be accomplished;
(8) The names of any other cities in which the person registering has solicited funds for charitable purposes within the past five (5) years but if the person registering has solicited funds for charitable purposes in more than ten (10) other cities, the person registering may list the five (5) cities in which the most solicitations occurred;
(9) The name of any officer, director trustee, partner, or any current agent or employee of applicant engaging in solicitation of funds who has been convicted of a felony or misdemeanor involving moral turpitude within the past five (5) years, the nature of the offense, the city and state where the conviction occurred, and the year of such conviction;
(10) A list of the persons, including their home addresses and telephone numbers who will actually be participating in the solicitation effort;
(11) If the person registering is unable to provide any of the foregoing information, an explanation of the reasons why such information is not available;
(12) A statement to the effect that when a certificate of registration is granted, such certificate will not be used as or represented to be an endorsement by the city or any of its elected officials or employees;
(13) The registration statement must be signed by the applicant, if the person registering is an individual; if the person registering is a partnership, by the partner charged with disbursing funds solicited; if the person registering is a corporation or an association, by its officer charged with disbursing the funds solicited. The individual making the registration statement shall sign the statement and swear or affirm before an officer authorized to administer oaths that he has carefully read the registration statement and that all the information contained therein is true and correct;
(14) The city clerk shall maintain on file in his office the registration statement provided for in this section for the period of time the certificate of registration, referred to in section 18-168, is in effect, or for ninety (90) days, whichever period of time is shorter and the city clerk shall make such registration statement available for review by any member of the public, upon request.
