Chapter 16 STREETS AND SIDEWALKS*
Section 16-2 Encroachments declared nuisance; abatement.
Any encroachment on, over, above, or beneath any street, alley or sidewalk in violation of this Code or any ordinance of the city is hereby declared a nuisance, and the mayor shall order such nuisance abated, giving the person constructing or maintaining it notice to remove it in twenty-four (24) hours. Upon failure by the person to comply with the order within the time specified, the mayor shall proceed to have the encroachment removed at the expense of the person constructing or maintaining such encroachment, and if such person fails or refuses to pay the expenses the mayor shall direct the city clerk to issue execution for the amount of such expenses and the marshal shall proceed to collect the execution in the same manner as is provided for the collection of tax executions.
